‘League Express understands that 88M have served a schedule of dilapidations on Trinity to reflect the cost of bringing the stadium into good repair. The cost is estimated to be at least £400,000’.

| As I expected. All parties are trying to co-ordinate and hammer trinity into a corner. I must say they are co-ordinating very well in that regard. The club staying silent with now three statements does not bode well for the club on a public front.
On a legal front we will see. Lools like the club are losing the arm wrestle unless there's a good hand to play on our side. Taking a political battering at the moment.

Unfortunately we are under fire from all angles now. Even if we do decide to up sticks then there's a £400k bill to contest now. Seems like the clubs options are becoming limited.
Hate to see this happening to my club and hope there's some actual good news off the field to come. What started as a good off season full of promise is looking like it could turn into a fastravk to hell. A bit extreme but I'm getting a little worried about what will happen to the mighty trinity.

At the moment this is still paper talk but stories like this don’t just get made up out of thin air, there has to be something in it. What’s the betting that the 400K bill would be ripped up should we sign up to the Belle Vue deal?

| So 88m are basically saying that since they bought the stadium, about a year or so ago, the ground needs spending £400k to bring it back to the standard it was when they purchased it, because that's my limited understanding of a Schedule of Dilapidation. Seems obvious they are trying to force us one way or the other. So much for 88m hey, but it seems all par for the course.
I was so looking forward to next season, especially after last and getting to see the new players plus any offers we may sign and see the team carry on it's improvemnets and I thought we'd agreed to stay at Belle Vue another year, obviously things have changed. All this that's happening is obviously making it unbeilevably hard for the Club in the off season, when all signs just a month ago suggested it shouldn't have been.
But more than that, it must be worrying for fans & even the players we've got, hearing news like this all the time. I just hope the Club has a plan behind all this silence and we can move on to next season because it's become more than worrying imo.

Quote [iAs a tenant, it is vital that all lease covenants are evaluated before
entering into a lease. For example, ‘to keep in repair’ requires the
tenant to first put the property into repair and this could be at a
great cost. The condition of the property before lease commencement
becomes largely irrelevant during dilapidations negotiations,
unless this is specially agreed and formally documented, perhaps
by way of Schedule of Condition, within the lease.[/i
'"
But there are also limits:
Quote [iA common misconception is that landlords can profit from a dilapidations
claim. Agreement of a financial settlement must only relate to
actual loss incurred as a result of the tenant’s failure to comply with
their lease. It is also important to note that landlords cannot expect
a building to be returned to ‘as new’ condition, only the condition
dictated by the lease covenants.
Section 18(1) of the Landlord and Tenant Act 1927 caps the
level of damages that can be claimed at lease end. It states that the
claim for damages cannot exceed the amount by which the value
of the premises is diminished owing to the breach. It further limits
the claim if you are to plan to redevelop or make substantial alterations
to the premises after lease expiry.[/i'"
Section 18(1) itself:
Quote 18 Provisions as to covenants to repair.
(1)Damages for a breach of a covenant or agreement to keep or put premises in repair during the currency of a lease, or to leave or put premises in repair at the termination of a lease, whether such covenant or agreement is expressed or implied, and whether general or specific, shall in no case exceed the amount (if any) by which the value of the reversion (whether immediate or not) in the premises is diminished owing to the breach of such covenant or agreement as aforesaid; [size=150=#FF0000and in particular no damage shall be recovered for a breach of any such covenant or agreement to leave or put premises in repair at the termination of a lease, if it is shown that the premises, in whatever state of repair they might be, would at or shortly after the termination of the tenancy have been or be pulled down, or such structural alterations made therein as would render valueless the repairs covered by the covenant or agreement.[/size'"

| I can't imagine MC would have agreed to a lease where we had to keep it in better condition, thus basically improving the Stadium, than when 88m bought it. Also like it says in the last sentence of the second paragraph, this seems to be a way to push Trinity out or into whatever scheme they have for the stadium, because it's obvious that if we went, it would be knocked down just as quick as the Superbowl was and they'd redevelop the ground.
It makes you laugh though when they bought the whole area for around the £600k asking price anyway.

| So this is a coordinated attack lead by Box, he obviously has McKay in his pocket as Mackay stands to make millions from not building a stadium at Newmaeket, 88M have firmly nailed there colours to Box`s mast , you have got to wonder what Box will have given Hussain in order to get him to be so aggressive in his approach. These people do not act in this manner unless they are going to to get a huge return, Box wants the mosque on BV and Hussain will make a decent return. That said I think there must be more to this to get Hussain to come out a be Box`s bully boy. I can only imagine that Box is looking after him in some other way.

If this matter is in the hands of solicitors, with the club still awaiting legal advice, there's no response going to come quick! Glaciers move quicker than solicitors.

As you say a lot will be down to the small print. As for the second part it will i guess depend on what the plans for the ‘Trinity-less’ community stadium are. If all of a sudden the lack of the need for a shiny new build means it becomes the current structure with a bit of a spruce up then it opens up a loophole that 88M seem to be all over.
